Republicans have been threatening to block the state from requiring voters to show identification to vote. But state officials said Monday that they will appeal.
Attorney General Eric H. Schneiderman said in a memo to the justices that if they do not reverse the decision, and that their legal team is ready to do so, “we will challenge its application in person to the United States Court of Appeals for the Sixth Circuit Court of Appeals.” After getting back to his desk at 12:30 p.m., H. R. Schneiderman sent some of the document to the court.
“We believe the state’s case should remain for a full day before the Supreme Court,” the memo said.
The decision would set a precedent of similar circumstances. On Nov. 8, 1996, two Republican state lawmakers and another voter fraud official who was fired from his position in the state’s Department of Voter Services got fired after a series of computer glitches compromised voter registration records. In October, a state judge ordered both state and federal authorities to reinstate those same records.
A second voter fraud official who was fired in 2005, Andrew R. Raskin, died in 2010 after he won the elections at the Republican convention, according to a lawsuit filed by several members of the House of Representatives and Republican state officials last year that challenged the dismissal.
